Terms and Conditions

By downloading, accessing, or using the HyperGrit mobile or web application ("HyperGrit" or the "Service"), you agree to be bound by these Terms of Use ("Terms"). HyperGrit is operated by Hyper Grit LLC (the "Company"), co-founded by Sundaram Chandrasekaran and Sivalingam Sundararaj Shanthi.

If you do not agree with these Terms, you must not use the Service. We reserve the right to update or modify these Terms at our sole discretion, and will provide notice of material changes at least 30 days before they take effect. Your continued use of HyperGrit after any changes indicates acceptance of the revised Terms.

Accounts and Eligibility

Eligibility

You must be at least 13 years old (or the minimum digital age in your jurisdiction) to use HyperGrit. If you are under 18, you represent that you have your parent or guardian's consent to use the app.

We do not knowingly collect personal information from children under 13, and will delete any such information if discovered.

Account Registration

When creating an account, you agree to provide truthful, accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Account Termination

You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate your account if we suspect a violation of these Terms or applicable laws.

Subscription, Purchases, and Payments

Free and Premium Tiers

HyperGrit offers both a free basic service and a Premium subscription ("HyperGrit Premium") for $3 USD per month. Subscriptions are billed monthly in advance and automatically renew unless canceled prior to renewal.

One-Time Purchases

HyperGrit may offer one-time purchase items such as workout templates. Purchases are final and non-refundable except where required by law. Unauthorized distribution is prohibited.

Payment Processing

Payments are processed securely by third-party providers such as Stripe, Apple App Store, or Google Play. HyperGrit does not store full payment card details.

Refunds

Subscription fees and purchases are generally non-refundable unless required by law. App Store purchases must be refunded through the platform.

Fee Changes

We may change subscription fees with advance notice. Continued use after a fee change constitutes acceptance.

License and Intellectual Property

Ownership

All content, software, and materials available on or through HyperGrit are the property of Hyper Grit LLC or its licensors and are protected by intellectual property laws.

Limited User License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes.

Prohibited Uses

• No unauthorized copying or distribution
• No modifications or derivative works
• No reverse engineering
• No unauthorized access or interference
• Personal and lawful use only

User-Submitted Content and Data

Your Content

You retain ownership of your personal fitness data. By submitting content, you grant HyperGrit a worldwide, royalty-free license to use and process it for providing the Service.

Responsibility for Content

You are solely responsible for your User Content and agree to indemnify HyperGrit for claims arising from it.

Feedback

Any feedback provided may be used by HyperGrit without obligation.

Third-Party Services and Links

HyperGrit relies on third-party services such as Stripe, AWS, Supabase, MongoDB Atlas, and Flutter. We are not responsible for third-party services or outages.

External links are used at your own risk.

Health and Safety Disclaimer

HyperGrit is a fitness tracking application and does not provide medical advice. Always consult a healthcare provider before beginning any exercise or diet program.

You assume all risks associated with exercise and use of the app.

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

Limitation of Liability

To the fullest extent permitted by law, Hyper Grit LLC shall not be liable for indirect, incidental, or consequential damages.

Total aggregate liability shall not exceed the amount paid in the last 12 months or $100 USD, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Hyper Grit LLC and its affiliates from claims arising from your use of the Service.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA.

Arbitration Agreement

All disputes shall be resolved by binding arbitration on an individual basis.
